Abdiwali Abdiqadir Muse is an adult
Regarding the captured Somali pirate, AP is reporting that "U.S. Magistrate Judge Andrew J. Peck said Abdiwali Abdiqadir Muse could be treated as an adult in U.S. courts."
Had he been considered a juvenile, would the law of nations piracy charge not have carried a mandatory life sentence? There are other lesser included charges as well.
How would the actual and wannabe criminal defense attorneys out there try to structure a defense for Muse? The other three guys made me do it?
Is that laughter I hear coming from Davey Jones' Locker?
UPDATE: via Ace and JWF, Air America host and lawyer Ron Kuby has an interest (sort of) in being Muse's defense attorney, and states:
"I think there's a grave question as to whether America was in violation of principles of truce in warfare on the high seas," said Kuby. "This man seemed to come on to the Bainbridge under a flag of truce to negotiate. He was then captured. There is a question whether he is lawfully in American custody and serious questions as to whether he can be prosecuted because of his age."

Ah, Kuby has obviously seen all three Pirates of the Caribbean movies multiple times and is quite familiar with the "parlez" concept.

Kuby refers to the pirate as a "man"; and in the very next breath says there's "serious questions as to whether he can be prosecuted because of his age"?

I hadn't known until now that, after being canned by WABC Radio, Kuby wound up at "Air America." Not surprised.
