Brace yourselves: The latest on "card check" 


The Corner's Peter Kirsanow reports on the latest Congressional inside baseball concerning the prospects for passage of the deceptively-named "Employee Free Choice Act." Sadly, it appears that Democrats really are going to push the legislation, which would effectively turn the management of American business over to the lawyers. The enactment of this law would do more to damage the great strength of the U.S. economy -- the flexibility of its companies -- than September 11 did, or another successful terrorist attack would do. It is that dumb.

And this differs from TARP how, exactly?
"If you don't buy our products, we can either a) sue you outright for failure to play 'capitalism', or b) get a bailout, and have the IRS separate you from your money"
In the future, you will get a law degree, vice a high school diploma, simply to know how to survive.

There is plenty of other employment legislation that could turn the world over to the lawyers with which employers should be concerned, such as the Fair Pay and Equal Pay Acts that are sure to pass.

As for "card check", the locomotive has slowed down. My one employment lawyer source (at a well-connected firm) believes it's on a slower track than the legislation I mentioned above, precisely for the reasons that Kersanow mentions (the unions will push hard, because their best chance is now, before the 2010 mid-term elections). It could be that the unions "settle" for some form of binding arbitration and call it a day, but this bill is where the Republicans will draw the line, try to filibuster, and then make it a huge issue in 2010.

If EFCA passes, the lawyers will be the least of the problem. There isn't enough staffing at the NLRB, companies or law firms to help handle the problems that will surely arise. Whether or not one believes in the merits of this law (and I do not), why is it a good idea to pass any restrictive and burdensome piece of legislation in the worst recession since the Great Depression? That's what makes absolutely no sense.
