Does Hamdan make George W. Bush a war criminal?
Andrew Sullivan thinks that the logical extension of the Hamdan decision -- which I have not yet read -- puts George W. Bush in jeopardy for prosecution as a war criminal. If so, three fairly obvious predictions and observations come to mind.
First, Sullivan's post will be a topic du jour on both left and right blogs today.
Second, if the Democrats seize upon this as the basis for post-November impeachment hearings, it will keep them out of the White House in 2008.
Third, I cannot think of a more compelling reason for the United States to continue to refuse to ratify the jurisdiction of the International Criminal Court.

Agreed on all three points, Tigerhawk.
As it is, I think that the Democrats have made it clear that if they win even one house of Congress, and especially the House, they will start impeachment hearings. No doubt that they will use this ruling against the president.
And if they continue down their current path of advocating "declare defeat and get out" of Iraq, the American people will not put them in charge of national security, no matter what the shortcomings of the GOP.
As for the ICC, it will be used to go after Westerners, and especially Israeli, British, and American politicians with whom the left disagrees. Hamas, Hezbollah, Fidel Castro, Robert Mugabe, they have nothing to fear.

The mere existence of the ICC is threat to us. We should do more than simply refuse to ratify it; we should actively seek to undermine and discredit it.
