The criminalization of business judgment -- or the giving of legal advice in connection therewith -- proceeds apace. Unless you are Warren Buffett.

This has all happened under George W. Bush. Imagine how crazy these prosecutions will become if Barack Obama is elected on a wave of populist rage against the bursting of the credit bubble.

I'm confused. Are you suggesting that a $500 million fraud did not occur or that the lawyer who advised on it should not be held accountable or that the penalty is disproportionate?
