Unless one is in favor of providing complete due process rights (procedural and substantive), I can't see how anyone can be in favor of extending constitutional habeas rights to these detainees.
I can understand how one is agnostic; but not how one can be in favor.
IOW, unless one knows exactly what due process rights the detainees will be given, one has to be silent as to whether they support the extension.
E.g., Senator Obama.
Part of our problem with waging our War on Terror has been the very small number of Americans who understand what war is and how one is waged. Years ago I starting asking people who were against the war what country we invaded first after the Japanese invaded Pearl Harbor. So far nobody has gotten it right. Because they are so ignorant of war, they fall back on lawsuits. When you are a hammer, everything starts to look like a nail, I guess.
